AZ Immigration Law - Summary

April 19, 2010 the Arizona legislature approved the law SB 1070 which includes provisions relating to immigration law enforcement, including trespassing, harboring and transporting illegal immigrants, alien registration documents, employer sanctions an human smuggling.


The State action has received support and opposition from other State legislatures.  And certainly there will be many Court challenges filed against the law by individuals and groups.


- Enforcement of Immigration Law; required to follow Federal guidelines and allows an official to reasonably attempt to determine the immigration status of a person involved in any situation of lawful detention.
- Failure to complete or carry Alien Registration documents; Every alien, 18 years of age or older, shall at all times have in their posession ant certificate of alien registartion or receipt card issued. Failure to comply is a misdemeanor offense and is fineable.
- Day Laborers; a Class 1 misdemeanor for any occupant of a motor vehicle for soliciting workers in a public place impeding traffic, or for an alien to knowingly apply for work an employee or contractor.
- Transporting Aliens; becomes a criminal offense to transport, conceal or shield an alien; or encourage an alien to come to the State. Exceptions for emergency personnel.
- Employer; requires employers to keep a record of employment verification for the duration of the employment or 3 years, whichever is longer.
